These terms apply to your use of the ApexTechX website. By using it, you agree to use it lawfully and not to disrupt the site, attempt unauthorized access, or misuse its forms or content.

Services and project agreements

Descriptions of eTIMS solutions, M-Pesa Daraja integrations, software development, and consultancy are summaries, not a binding offer or promise that every feature is available for every project. Scope, deliverables, fees, timelines, support, and acceptance criteria are confirmed in a proposal or other written agreement.

If a signed or otherwise accepted service agreement conflicts with these website terms, that agreement governs the relevant service.

Your responsibilities

You are responsible for:

• Providing accurate information and ensuring you have the rights and authority to share any data, materials, credentials, or business records supplied to us.
• Maintaining your own accounts and access credentials, and promptly notifying us if you suspect they have been compromised.
• Reviewing your statutory, tax, payment, and record-keeping obligations with the relevant authorities or qualified advisers.
• Using integrations and software in accordance with applicable law and the terms of third-party services such as KRA and Safaricom.

Third-party platforms and compliance

KRA, Safaricom, hosting providers, payment platforms, and other third parties operate services that are outside our control. Their availability, rules, approval processes, APIs, and requirements may change. An integration or support service does not guarantee uninterrupted third-party service, acceptance of a transaction, or that your business meets every regulatory obligation.

You remain responsible for the accuracy of your business records and for confirming compliance requirements that apply to your operations. We can assist with implementation but do not act as KRA, Safaricom, or a regulator.

Intellectual property

Unless a written agreement says otherwise, the website’s design, copy, branding, and original materials belong to ApexTechX or its licensors. You may view and use them for personal or internal evaluation, but may not copy, republish, or commercially exploit them without permission.

Ownership and licensing of project-specific code, deliverables, and materials are determined by the applicable project agreement. You retain responsibility for materials and data you provide.

Availability and liability

We aim to keep the website and services reliable, but do not promise that this website or any third-party system will always be available, uninterrupted, or error-free. Website content is provided “as is” for general information.

To the extent permitted by law, ApexTechX is not liable for indirect or consequential losses arising from use of this informational website. Nothing in these terms excludes liability that cannot lawfully be excluded or limits any non-excludable consumer rights. Any service-specific limits are governed by the written service agreement.

Law and changes

These website terms are governed by the laws of Kenya, subject to any mandatory legal protections that apply to you. Disputes concerning a contracted service are handled under the dispute-resolution provisions in the relevant agreement.

We may revise these terms as the website or our services change. The latest revision date appears above. Continued use after an update means the revised terms apply to your future use of the website.
